Please read these Terms of Service ("Terms") carefully before downloading, installing, or using the SolarMark mobile application (the "Application") or visiting the website at solarmark.us (the "Website"). The Application and Website are collectively referred to as the "Service."
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not install, access, or use the Service.
1. Scope of Service & Local-Only Architecture
The Application is a strictly local software utility designed to read and display solar energy performance metrics (inverters and batteries) directly from compatible hardware on your local area network (LAN).
- No Cloud / No Accounts: The Application operates entirely on your local device. There are no user accounts, external databases, or cloud processing services.
- No Write Operations: The Application utilizes standard Modbus TCP read-only commands. The Application does not perform write operations of any kind, nor does it modify, alter, or configure any settings, safety parameters, or grid-tie rules on your inverter or battery storage equipment.
- Local Storage & Recovery: All historical data is stored locally on your mobile device (e.g., via SQLite). Backup and recovery of this data are performed locally or through native device storage options managed solely by you. We do not have access to, nor do we store or back up, your data.
2. Independent Utility & Global Trademark Disclaimer
- No Affiliation: SolarMark is an independent software utility. SolarMark is not affiliated with, authorized, sponsored, endorsed, or in any way officially connected to any of the hardware manufacturers or solar service companies referenced on our Website or within the Application.
- Ownership of Marks: All third-party trademarks, brand names, service marks, and logos (including but not limited to SolarEdge, SMA, Fronius, Enphase, Huawei, Sungrow, Growatt, Sol-Ark, GoodWe, Deye, etc.) are the property of their respective owners. Our use of these names is strictly for Nominative Fair Use to identify the specific hardware with which our software is compatible. This use does not imply any partnership or endorsement by these companies.
3. Protocol Integration & Technical Compatibility
- Public Protocols: The Application interfaces with third-party hardware using public-facing, industry-standard communication protocols (such as SunSpec Modbus TCP) or publicly available register maps.
- No Proprietary Intrusion: Use of these protocols does not constitute an attempt to circumvent security measures or access proprietary, trade-secret, or "encrypted-only" communication channels of the hardware manufacturers. The Service simply acts as a local client for existing data-sharing features already present on local hardware.
4. Solar Installer Industry Disclaimer & Non-Competition
- No Installer Services: SolarMark is a software utility only. We do not sell, install, maintain, repair, or provide physical engineering services for solar panels, inverters, battery storage, or electrical grids.
- No Interference with Business: The Service is not intended to interfere with, compete with, or bypass the legitimate business operations of commercial solar installation companies, engineering firms, or technicians.
- SetApp / Installer Account Responsibility: Configuring an inverter to enable "Modbus over TCP" may require physical interaction with the inverter or access through manufacturer-restricted apps (such as SolarEdge SetApp). You acknowledge and agree that any decision to access, configure, or request configuration of your hardware is done at your own discretion. We accept zero responsibility or liability for any actions, service charges, or service calls initiated by your solar installer as a result of your utilization of Modbus TCP settings.
5. Disclaimer of Compatibility & Maintenance
- Manufacturer Control: You acknowledge that third-party manufacturers control the firmware and software environments of their devices. We cannot guarantee continued compatibility if a manufacturer chooses to encrypt, disable, or restrict local network access (e.g., Modbus TCP) via a firmware update.
- No Obligation to Update: While we strive to maintain support for the brands listed, we are under no obligation to provide software updates to bypass new manufacturer-imposed restrictions or changes in local communication protocols.
6. Limitation of Liability & Equipment Warranty Safeguard
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE APPLICATION IS AT YOUR SOLE RISK. Under no circumstances shall the developer of SolarMark, its associates, or affiliates be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to:
- Hardware Damage or Malfunction: Any damage, faults, grid disconnection, or hardware errors occurring on your solar inverter, batteries, home electrical systems, or connected appliances.
- Manufacturer Warranty Voiding: Any claims that utilizing standard local Modbus TCP protocols voids, suspends, or otherwise impacts your manufacturer hardware warranty.
- Financial Losses: Any perceived loss of solar production, loss of savings tracking accuracy, feed-in tariff errors, or discrepancies in calculations within the app compared to physical utility billing.
- Data Loss: Any loss or corruption of historical energy data stored locally on your mobile device.
In no event shall our total cumulative liability to you for all damages exceed the actual amount paid by you, if any, to purchase the Application ($19.99 USD or local equivalent).
7. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in that jurisdiction.
8. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Your continued use of the Application following the posting of any changes constitutes acceptance of those new Terms.
